The 2023 Legislature passed House Bill 114, which makes changes to student discipline for marijuana, THC, and e-cigarettes use/possession. The bill goes into effect on September 1, 2023.
Under HB 114, school districts are required to place a student in an Disciplinary Alternative Education Program (DAEP) if it finds that the student possesses, uses, is under the influence of, sells, gives, or delivers marijuana, THC, or e-cigarettes on or near school property or at school-sponsored events. This includes possession of any part or accessory of an e-cig device.
Federal and state regulations apply to students receiving special education or 504 services, as appropriate.
School districts are also required to provide a program of educational and support services to students who are disciplined under HB 114. This program must include information about the dangers of drug use and alcohol abuse, as well as strategies for avoiding drug use and alcohol abuse.
The goal of HB 114 is to reduce drug use and alcohol abuse among students in public schools. By providing students with information about the dangers of drug use and alcohol abuse, and by offering them support services, HB 114 aims to help students make healthy choices and stay drug-free.
